Aksyon Kalikasan welcomes; with critical view these milestone 7 countries that have declared nature to have personhood or legal status allowing for legal actions to be taken in behalf of ecosystems and habitats. In the Philippines we already have an IGE - Inter Generation Equity jurisprudence allowing for legal representation of the youth and the next generation for environmental rights cases. Declaring rights of nature would further enhance this. However, we also recognize that in densely populated and generally poorer countries, such as the Philippines (despite our categorization as a middle income country), these types of legal recognition often conflicts with rights of poor communities who live off these ecosystems and habitats. Thus, a crucial element in considering further the use of these legal principle in the context of the Philippines is to secure the rights of certain "peoples" who have prior rights in these habitats and ecosystems such as the Indigenous Peoples (IPs) (including the Cordillera and Mindanao's Lumads), the Bangsamoro to have the priority to represent these rights of nature. Aksyon Kalikasan also cautions that based on our experience, it is the lack of enforcement of plans and policies that is our waterloo in environmental governance and not new laws and yes, new legal principles. While recognize that in principle, the idea of bestowing the rights of nature is important to change the perspective and mindset of people and communities, it may not be the most effective and immediate means to move change that we so badly need in managing our environment and protecting, conserving and rehabilitating our ecosystems and our biodiversity.
